These Terms form a binding agreement between you and Zweka Technologies Ltd for use of the Zweka Platform.

1. Agreement

By creating an account, listing, bidding, offering, paying, or otherwise using Zweka, you agree to these Terms, the Acceptable use policy, Privacy policy, Cookie policy, Billing policy, Return & refund policy, Dispute policy, and Intellectual property policy (together, the “Policies”).

2. Eligibility

  • You must be at least 18 and able to form a binding contract under Nigerian law.
  • Businesses must have authority to bind the entity named on the account.
  • You must not be prohibited from using payment or marketplace services.

3. Accounts and verification

  • Provide accurate information and keep it updated.
  • You are responsible for activity under your credentials.
  • Sellers must complete identity verification before publishing. One natural person should not operate multiple seller identities to evade bans or limits.
  • We may require re-verification after disputes, risk signals, or regulatory need.

4. Our role

Zweka provides a venue and tools for users to list and transact. Except where we expressly act as seller, contracts for goods are between buyer and seller. We facilitate payment holding through licensed payment partners; we are not a bank and do not provide deposits in the banking sense.

5. Listings

  • You must own or be authorised to sell/trade/give the item.
  • Descriptions, condition, photos and prices must be honest and not misleading.
  • Reference prices on deals must support a genuine clearance discount.
  • We may remove, demote, or refuse listings that violate Policies or law.
  • Publishing requires a contact phone on the seller account where the product requires it.

6. Modes (deal, auction, swap, giveaway, pre-order)

  • Deal: fixed or negotiable sale; buy-now and/or offers as configured.
  • Auction: bids may be binding per auction rules; anti-snipe extensions may apply; winners who fail to pay may lose the item and face strikes.
  • Swap: each side must perform agreed exchange; cash top-ups follow payment rules when used.
  • Giveaway: no purchase price; giver selects an applicant; abuse (hoarding, fake need) may be limited.
  • Pre-order: you pay the unit price now; we hold the money until stock is ready and handover is confirmed. The seller sets a ready date (and may push it once). If stock is still not ready after that date plus a short grace period, you may cancel for a full refund. Changing the listing price later does not change what you already paid.

7. Payments and escrow-style holding

  • Where payment is required, you authorise charges via our payment partners.
  • Funds for eligible orders are held and released according to order status, confirmation, expiry of the dispute window, or a dispute ruling — see Returns and Disputes.
  • Paying a seller directly outside Zweka voids Platform payment protection for that payment.
  • Currency is Nigerian Naira (₦) unless stated otherwise.

8. Fees and coins

Service fees, promotions and coin prices are described at purchase time and in the Billing policy. Coins are prepaid platform credit: they are not legal tender, are not redeemable for cash, and cannot be transferred between users except as we expressly allow.

9. Chat and contact reveal

  • Keep trade communication on-Platform where required.
  • Phone numbers may stay masked until payment or an explicit reveal flow with risk notice.
  • Soliciting off-platform payment may trigger flags, reports and enforcement.

10. Fulfilment

Meetup and courier options depend on the listing and order. Risk of loss and inspection duties follow the order flow and Return policy. You must provide accurate addresses and be available for handover.

11. Prohibited use

You must comply with the Acceptable use policy. We may investigate and act on violations without prior notice where risk is urgent.

12. Intellectual property

Platform software, marks and content we create are owned by us or our licensors. User content licence and complaints are governed by the IP policy.

13. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY NIGERIAN LAW. WE DO NOT WARRANT uninterrupted service, that listings are accurate, or that goods will meet your expectations. Statutory rights that cannot be excluded remain intact.

14. Limitation of liability

To the maximum extent permitted by law, Zweka Technologies Ltd is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill. Our aggregate liability arising out of the Platform in any 12-month period is limited to the greater of (a) fees you paid us (excluding amounts held for sellers) in that period and (b) ₦50,000 — except where liability cannot be limited (e.g. fraud by us, or death/personal injury caused by our negligence where such rules apply).

15. Indemnity

You will indemnify and hold us harmless from claims arising from your listings, goods, content, breach of Policies, or violation of law, except to the extent caused by our wilful misconduct.

16. Suspension and closure

We may suspend or terminate access for Policy breaches, legal risk, or prolonged inactivity. You may close your account in Settings subject to open orders and retention rules in the Privacy policy.

17. Governing law and disputes with us

These Terms are governed by the laws of the Federal Republic of Nigeria. Courts of Nigeria have exclusive jurisdiction, without prejudice to mandatory consumer protections. First contact legal@zweka.ng to seek an amicable resolution.

18. Changes

We may update these Terms by posting a new version. Continued use after the effective date constitutes acceptance where permitted. If you disagree, stop using the Platform and close your account.
